Ramadan- Month of Revealing the True Constitution


“Verily, We have sent it down in the Night of Al-Qadr. And what will make you know what the Night of Al-Qadr is. The Night of Al-Qadr is better than a thousand months. Therein descend the angels and the Ruh by their Lord's permission with every matter. There is peace until the appearance of dawn.”
[TMQ Al-Qadr]

Allah (SWT) revealed his words Quran to guide the humanity. This final revelation was down all at one time from the Preserved Tablet (Al-Lawh Al-Mahfuz) to the House of Might (Baytul-`Izzah), which is in the heaven of this world. Then it came down in parts to the Messenger of Allah based upon the incidents that occurred over a period of twenty-three years. This glorious incident occurred in the Laylat al-Qadr (Night of power). Ulema agreed upon on the matter that Laylat al-Qadr is in the last ten days of Ramadan. Night of Qadr is most superior of nights over a year and which is better than thousands months. So there is no doubt that the Ramadan is the holiest month is sight of Allah since in it the best of nights are present. Also, in this month were revealed the scriptures of Ibrahim (as) and Musa (as), as well as the Zabuur and the Injeel. During this month gates of Mercy are wide open, the gates of hell are shut and the Shayateen are chained up. It is a month chosen by Allah (SWT) as a month of fasting; an act of Ibadat that Allah (SWT) made special to Him. He (SWT) favoured this month over all other months by making it the month of mercy and reverence for all the believers.

The Futile Debate Created by the Imperialists and Their Agents in This Holy Month

When people of Bangladesh made preparation to embrace the holiest month, there arose a futile debate by the so called constitution review committee of Bangladesh. The ruling elite have started this baseless debate which is about the constitution of the country and it’s amendment. There arose two parts on this drama as usual. On the one side of the debate is the governing camp advocating the restoration of the 1972 constitution and on the other side is the camp of the opposition advocating the retention of the Fifth Amendment.

However what good is there for the country whether we restore the 1972 constitution or retain the Fifth Amendment? The 1972 constitution was drafted by agents of the polytheist state, India, in order to shape the political medium of the country in such a way as to serve her interests. The Fifth Amendment was a move by agents of crusader America in order to re-organize the political set up and establish her foothold in the country. Therefore the current debate is futile and has nothing to do with the wellbeing of the Ummah. This debate has been created by the imperialists, USA-Britain-India, and their agents in the government and the opposition to prevent the people from resuming the living by Islam.

The truth of the matter is that both the 1972 constitution and the Fifth Amendment contradict the fundamental basis of Islam because they are agreed upon the core principle of granting man the sovereignty to legislate laws according to the whims and desires of the rulers, and what achieves their selfish benefit. Islam does not allow the Muslims to adopt a constitution which confers authority upon man to legislate, whether it declares secularism as the basis as in the case of the 1972 constitution or it begins with the Bismillah and expresses ‘complete faith and trust in Almighty Allah’ as inserted by the Fifth Amendment. It is all the same whether the one who drinks alcohol in a bar does so without saying the Bismillah; or he enters the bar expressing his faith and trust in Allah, and drinks by saying Bismillah. Islam considers legislation by man as ascribing partners to Allah (SWT) and this is an unforgivable crime whether it is done by the majority in a so-called democratic parliament, or by a dictator, autocrat or monarch. Allah Said:

“The command is for none but Allah. He has commanded that you worship none but Him; that is the (true) straight religion, but most men know not.” [TMQ Yusuf: 40]

Allah (SWT) obliged upon the Muslims that their state must be based upon the Islamic Aqeedah and this is the Khilafah state. So participating on this futile debate will be a loss for Ummah since this debate happening on wrong ground and it will establish the kufr constitution at the end. Debate on saying bismillah before drinking alcohol rather than a debate on permissibility of drinking alcohol, will allow drinking alcohol. Similarly debate on both kufr constitutions will allow one of the kufr constitutions at the end. It is more dangerous because keeping bismillah in the constitution and declaring belief in Allah without implementing it will make Ummah more confuse. Ummah will start thinking that the current constitution is Islamic or more Islamic though in reality this is another face of kufr.

Constitution and Sources of Constitution

It is a fact that people of Bangladesh don’t understand what a constitution is. So it is important to understand the definition of constitution and its nature in a simple way. In simple words, the basic law for every government is called a constitution. The term constitution has been defined as the canon which outlines the shape of the state and its ruling system, and explains the limits and functions of every authority vested in it, or the canon which organises public authority, i.e. the government, defines its relationship with its subjects, and assigns both the State's rights and duties towards the subjects and the subject's duties and rights towards the State. Since the constitution is the principle by which a government governs its people, it is essential for running a state. Every civilized nation in this world has a constitution.

Constitutions and canons are taken from two sources. The first being the source from which they directly originate, such as norms, religion, the opinions of jurists, court precedents and the principles of justice and equity. This is known as the legislative source. . Examples of this type of constitution are some of the Western states like Britain and America. The second is a historical source, i.e. the source from which the constitution or canon emerges or is taken, like the French Constitution and the constitutions of some of the states in the Islamic world, like Turkey, Egypt and Syria.


Quran is Our Constitution and it is from Correct Source

Allah (SWT) revealed Quran as our constitution. He (SWT) said:

“The month of Ramadan in which was revealed the Quran, a guidance for mankind and clear proofs for the guidance and Al-Furqan (criterion).” [TMQ-Al-Baqarah: 185]

Definition of constitution fits with this verse. Here Allah (SWT) is explaining that the Allah revealed Quran as the principles and guidelines of human action from personal life to state life. It is the book which is only criterion between good and bad i.e. through Quran Allah (SWT) only legislate. His is the legislator and his legislation was revealed in the Quran to Mohammad (SAW).

It is an obligation upon the Muslim Ummah to establish the Islamic Aqeedah is the basis of conducting the Ummah’s affairs. The Islamic Aqeedah must be the basis of the Ummah’s state and its constitution; and all laws and rules must be derived from the Qur’an and Sunnah. Allah (SWT) has declared it to be a negation of Iman if the basis of the Ummah’s constitution, ruling and judiciary is other than ‘La ilaha illAllah, Muhammadur RasulAllah (SAW).’Allah (SWT) said:

“But no, by your Lord, they can have no Iman, until they make you judge in all disputes between them, and find in themselves no resistance against your decisions, and accept with full submission.” [TMQ An-Nisa: 65]

It is proven beyond doubt that the Quran is from the ultimate creator Allah (SWT). So it is the only correct source of a constitution which is free from error. Is the Quran the criterion (Furqan) upon which we base our actions whether it is our prayers, relationship with our parents, Societal relationship, financial transactions,, insurance, stock market shares, nationalism, tribalism, backbiting, slander, pornography, engaging in da’wah, working for the unity of the Muslims and re-establishment of the Quran as the source of law in the Muslim world through the establishment of an Islamic government? There is no doubt that the Quran is able to solve all these problems ranging from spiritual problem to economic and political problems. By the implementation of Quran Islamic State (Khilafah) became the most powerful nation in the world and her superiority lasted over 1300 years.

Does Quran Have the Impact on Us?

Aisha (RA) described the Prophet’s (SAW) character as being the walking Quran. We are his follower. Are we in our characters like the Quran? Do we feel the weight of the Quran on our shoulders like the companions of the prophet? Today in Ramadan we have competition on recitation of Quran. But do we understand, practice and implement the Quran in our lives? Mu’ad ibn Jabal (RA) once called the people of the town describe of our time probably:

“Today the reciters of Quran are few but the implementers are many, what of the time when the reciters will be many and the implementers will be few.”

During the life of prophet (SAW) there were few Muslim but they used to implement the Quran completely. Now we have over one and half billion Muslims among them many are reciters but the implementers are few. Is Quran has the impact on our souls. Let us look at the impact that this Quran had on the Sahabah and the Muslims in the past; it is known that some of the Sahabah when hearing a verse of the Quran would faint.

How sahaba had effect of Quran on them can be understood by listening to their stories. In the early days of Islam, Muslims were few in number and oppressed. That time, the companions of the prophet decided to recite the Quran openly and loudly in front of the Quraysh. Young boy Abdullah ibn Masud (RA) wanted to do it but the companions were afraid for him that he might be oppressed. Abdullah ibn Masud insisted so he was allowed. He then went out and stood near Maqam Ibrahim (a few meters from the Kabah). It was dawn and the Quraysh were sitting around the Kabah. Abdullah stopped at the Maqam and began to recite:

“In the name of Allah, the Beneficent, the Merciful. Ar-Rahman (The Most Merciful). He has taught the Quran.He has created man and taught him the clear speech….” [TMQ Ar-Rahman: 1..]

He went on reciting. The Quraysh realized Abdullah was reciting some of what Muhammad (SAW) brought. Then they went up to him and began beating his face as he continued reciting. When he went back to his companions the blood was flowing from his face. "This is what we feared for you," they said. "By Allah," replied Abdullah, "the enemies of Allah are not more comfortable than I at this moment. If you wish I shall go out tomorrow and do the same."

This is how the Abdullah ibn Masud (RA) was beaten for reciting Quran. He was reciting some simple verses yet the unbelievers decided to hit him. But we get praising words from the kuffar. This is because Sahaba challenged the kufr system and their leaders. So they recited: “Perish the two hands of Abu Lahab and perish he!” but we pray for the traitor rulers like Zardari, Mubarak, Hasina, Khaleda and recite “O Allah! Protect them”. Shahaba wanted to change Kufr System into Islamic system but how many of us want it?

Another example can be women of Madina. When the verses of hizab were revealed, the women in Madina took their curtains and covered them up immediately to fulfil the obligation. But today, in this month of Quran, step for banning hizab is taken in Bangladesh. Recently Bangladesh High Court willingly has given a verdict that the hizab cannot be forced. We do not question even, women made naked forcefully in this country but can’t they be made wearing hizab? Did we ask question, why should hijab be banned while Allah made it obligatory? Women in Madina did not even wait a moment when they heard hizab was obliged. Why do we make excuse?

The companions of Prophets (SAW) were driven by spirit of Islam. Quran had the greatest impact on them. We should be driven by the same spirit and work for the implementation of Quran throughout the globe. The implementation of the Quran is what the world is in need of today. Implementing the Quran doesn’t just mean reciting it beautifully rather it mean practice the hukm of Allah in life affairs. We Muslim should look at the oppression in every place, in Iraq, Palestine, Kashmir, in West where millions of people living in poverty and addicted to drugs, alcohol, etc, in India women are treated as slaves and country is in poverty and the rich are getting richer, in Bangladesh corruption is rampant and many girls committing suicide for the sexual assault. If we have the same impact of Quran sahaba had we will be able to solve human problems shortly.

Let us Establish Quran

There is no doubt that the Quran is our constitution. Quran demands to the Muslims to establish the Islamic constitution and the Khilafah state to remove injustice from this earth. However we should not be vague in stating like ‘the Quran is the Constitution’ without remarking Islamic system properly. We should define all our action from Quran and Sunnah. Therefore a constitution from Quran and Sunnah should be prepared to run the upcoming state ‘Khilafah’ from the first moment. We should feel the weight and burden of Quran and must work to establish it on all our actions from personal to international. We should not be fooled by imperialists and participate in a debate prepared by them. Rather we should understand the situation and demand for the Islamic system. Allah Said:

“Had We sent down this Quran on a mountain, you would surely have seen it humbling itself and split asunder (crumbling) by the fear of Allah. Such are the parables that We put forward to mankind that they may reflect.” [TMQ - Al-Hashr: 21]

Allah (SWT) is saying that if He had sent the Quran upon a mountain, imagine the size and magnitude of a mountain, the mountain would split asunder by the fear of Allah and from humbling itself. We are not as strong as mountain but Quran revealed on us. We should have become smooth particles from humbling ourselves.

Let us understand the Quran and became smooth particles. Let us establish the Quran. May Allah give us opportunity to work for Quran. Ameen.
